Attorney Indicates Trump to Seek Mistrial in New York Fraud Case Shortly
Alina Habba, the legal representative for former President Trump, announced her intention to request a mistrial regarding the fraud case against him in New York. She highlighted potential issues with impartiality, citing the presiding judge and his chief clerk as being politically influenced.
The judge, Arthur Engoron, has previously enforced a gag order to prevent Trump and other involved parties from publicly discussing his staff. Following an infringement of this order, Trump was fined $10,000 last month.
In a conversation on “Sunday Morning Futures” on Fox News, Habba was limited in her response due to the gag order but indicated that upcoming legal filings would address their concerns.
She hinted at the mistrial request being filed imminently. Habba pointed out the complexity of having the same judge, who they’ve sought to recuse on two occasions and who issued the gag order, to decide on matters such as mistrial and recusal.
The trial is a bench trial, meaning it is conducted by a judge without a jury. With the judge in question making pivotal decisions, Habba expressed concerns, especially considering what they have come to understand about the situation.
The defense for Trump is set to commence its argument in the New York case on Monday. The state’s Attorney General, Letitia James, has brought a lawsuit against Trump, his company, and his adult sons, alleging fraudulent activities aimed at securing lower tax rates and improved insurance terms by manipulating asset values. Trump and his sons refute these allegations.
