Stefanik Celebrates as Court Overturns ‘Unconstitutional’ Restriction on Trump
Representative Elise Stefanik (R-N.Y.) has expressed triumph following a decision by a New York appeals court to temporarily suspend a gag order that had prevented former President Trump and his legal team from discussing the trial judge’s staff in his ongoing New York civil fraud case.
Stefanik, in her statement, expressed satisfaction, particularly after her recent ethics complaint to the New York Commission on Judicial Conduct against Manhattan Judge Arthur Engoron. She described the lifting of the gag order as a win for constitutional rights, stating, “I am pleased to see that after my ethics complaint… an appellate court has lifted the unconstitutional gag order against President Trump.”
This development comes in the wake of an urgent lawsuit filed by Trump’s attorneys on Wednesday. They argued that the gag orders cast doubts on Judge Engoron’s impartiality in Trump’s case. The legal team sought an interim stay on both the gag orders and the sanctions imposed due to Trump’s non-compliance. These orders were initially issued following Trump’s online remarks about the judge’s principal law clerk, which included sharing her personal information.
Trump, known for his outspokenness, has faced a $15,000 fine for various infractions and was unexpectedly summoned to testify about his comments. The appellate judge, in the recent ruling, raised concerns that the gag orders might infringe upon Trump’s freedom of speech. Consequently, Trump is now free to speak about Engoron’s staff as the appeal proceeds.
Stefanik, a fervent Trump ally, had previously filed a judicial ethics complaint against Judge Engoron. She accused him of exhibiting bias and lack of judicial temperament towards Trump and called for his resignation. In her statement, Stefanik emphasized the broader implications of the case, asserting, “We must fight to protect all defendants’ First Amendment and due-process rights,” and stressed that the issue extends beyond Trump.
