GOP senator says Biden can’t be impeached for pre-presidential actions

Republican Senator Markwayne Mullin of Oklahoma cautions his House GOP colleagues that impeaching President Biden for actions or alleged offenses prior to his 2020 presidential election is not viable. In a Newsmax interview, Mullin casts doubt on the ongoing House Republican probe into the Biden family’s business engagements, especially Hunter Biden’s dealings with foreign firms during and just after Joe Biden’s vice presidency under Obama.

Mullin emphasizes that impeachment grounds, such as high crimes or misdemeanors, must relate to the President’s conduct during his current term. Actions during his vice presidency or in the interim period may not qualify for impeachment, he explains on Newsmax’s “Wake Up America.”

He also advises ensuring any impeachment case is convincingly prosecutable, acknowledging the high standard required. This perspective aligns with the stance of several Senate Republicans, including Senate GOP Leader Mitch McConnell, who acquitted former President Trump in 2021, citing his no-longer-being-in-office as a key factor.

Mullin’s remarks follow a party-line House vote approving a formal impeachment inquiry into President Biden, focusing on potential improper benefits from Hunter Biden’s foreign business activities. In response, Hunter Biden firmly stated at a Capitol news conference that his father had no financial ties to his business ventures.

The House GOP’s investigation timeline targets events between 2014 and 2017, when Joe Biden served as vice president and shortly thereafter. However, other Republican senators, like Senate Republican Whip John Thune and Senator John Cornyn, have cautioned that convicting Biden in a Democrat-majority Senate seems highly unlikely. Conviction and removal from office would necessitate at least 18 Democratic senators voting for it, a challenging threshold to meet.
