Biden To Be Removed Using 25th Amendment?
In response to President Biden’s perceived underperformance during a recent debate with former President Trump, Representative Chip Roy (R-Texas) has proposed a significant course of action. Roy introduced a resolution urging Vice President Kamala Harris to convene the Cabinet to assess President Biden’s capacity to perform his presidential duties. This move was motivated by Biden’s difficulties during the debate, where he appeared to struggle with his speech and coherence, sparking concerns among observers and members of his own party.
The resolution introduced by Roy calls upon Vice President Harris to utilize her authority under Section 4 of the 25th Amendment. This amendment, which has never been previously invoked, provides a mechanism for the Vice President and a majority of the Cabinet to declare a president unable to fulfill the responsibilities of the office, thereby allowing the Vice President to assume the role of Acting President.
Roy’s call to action is not intended to enforce any legal requirement on the Vice President or the Cabinet but serves as a formal expression of concern from the House of Representatives about the President’s capability to govern effectively. Roy stressed that his resolution is based on objective observation rather than political strategy, emphasizing the importance of presidential capability in a world facing complex and escalating threats.
Speaker of the House Mike Johnson (R-La.) echoed Roy’s concerns later that day, suggesting that it might be prudent for Biden’s cabinet to consider the implications of the debate performance. However, Johnson acknowledged that the constitutional process to evaluate a president’s fitness for office rests not with Congress but within the Cabinet guided by the stipulations of the Constitution.
Despite these concerns, Vice President Harris defended President Biden’s debate performance on CNN. She admitted that Biden started slowly but highlighted his strong finish and the substantive distinctions he drew between his and Trump’s policies and visions for the country. Harris focused on the importance of substance over style in the presidential election, criticizing Trump for his repeated falsehoods during the debate.
Following the debate and amidst discussions of the resolution, Harris’s spokesperson, Ernie Apreza, affirmed her support for President Biden, expressing enthusiasm for continuing their work together in a potential second term. This statement underscores a commitment to the current administration’s goals and leadership, despite the controversy stirred by the debate and subsequent calls for evaluation under the 25th Amendment.
