Trump Reflecting Pool Case Takes A Drastic Turn

Attorneys representing former Olympian David Hearn argue that the Lincoln Memorial Reflecting Pool was already deteriorating before prosecutors claim he caused any damage, pointing to witness testimony they say undermines the government’s case.

The latest court filing comes after months of attention surrounding the Reflecting Pool, which has experienced algae growth, leaks and a deteriorating liner despite a $14 million rehabilitation project.

Hearn, 67, was detained by National Guard troops and U.S. Park Police on June 19 after entering the Reflecting Pool to examine what he said was peeling paint and visible deterioration. He was later indicted on a felony charge related to the incident.

Hearn has maintained his innocence, insisting he did nothing wrong and claiming he was unfairly singled out.

In a court motion filed this week, Hearn’s attorneys argued that the government’s own witness acknowledged before a grand jury that the Reflecting Pool was already in poor condition before the incident. According to the filing, the witness testified that repairs would have been necessary regardless of Hearn’s actions.

The defense contends that the testimony raises serious questions about whether Hearn caused any measurable damage at all and argues prosecutors have failed to establish that his actions resulted in additional harm beyond the pool’s existing condition.

The case continues as both sides prepare for further court proceedings over the charges stemming from the June incident.
