Fulton County Prosecutors Request Protective Order Following New Video Evidence
Prosecutors in Fulton County urgently filed for a protective order in a case involving alleged election interference after plea deal recordings of several defendants were leaked.
ABC News and The Washington Post recently aired clips of these proffer sessions, revealing four guilty-pleading defendants being interrogated about their roles in attempting to reverse the 2020 election outcomes.
The prosecutors, concerned about witness intimidation and trial obstruction, asked the court to limit how defendants share these materials. They emphasized that the release of these videos, which were part of discovery, could lead to harassment and threats against witnesses, and hinder justice.
To prevent further leaks, the prosecutors decided to stop giving defendants video copies of proffer sessions. Instead, defendants will need to visit the District Attorney’s office to watch these videos, without the ability to record or reproduce them.
Fulton County District Attorney Fani Willis charged former President Trump and 18 others with racketeering, alleging a conspiracy to illegally maintain Trump’s power post-2020 election.
Of these 19, four have accepted plea deals, including three lawyers aligned with Trump: Sidney Powell, Jenna Ellis, and Kenneth Chesebro, plus bail bondsman Scott Hall. They agreed to testify truthfully against the other defendants, who all pleaded not guilty.
ABC News reported details from Ellis’s session, where she recounted a December 2020 conversation with Trump official Dan Scavino about Trump refusing to leave office. Powell’s session, as per The Washington Post, involved discussions about possibly being appointed special counsel to investigate election fraud and conflicts with Rudy Giuliani, another defendant.
Following the footage release, Ted Goodman, an adviser to Giuliani, claimed that Powell’s statements absolved Giuliani of conspiracy involvement and criticized Willis for not dismissing the charges against Giuliani.
