Former President Trump has taken action to pause proceedings in his election interference case after filing a notice of appeal aimed at overturning a federal judge’s decision denying his motion to dismiss the case.
In successive motions, Trump has requested that Judge Tanya Chutkan, who presides over the Jan. 6 case, suspend “all district court proceedings in this case” while a higher court reviews Trump’s appeal regarding the dismissal of the entire case.
This move could disrupt Trump’s scheduled trial date on March 4th in the case, and prosecutors have contended that Trump is employing every available avenue to disrupt the proceedings, potentially delaying the matter until after the 2024 election. Trump is facing charges related to his efforts to remain in office after losing the 2020 election.
In a ruling issued last Friday, Chutkan rejected Trump’s motion to dismiss the case based on claims of presidential immunity and constitutional grounds, including the First Amendment. Chutkan emphasized that no sitting President enjoys a lifelong immunity from federal criminal liability, and that former Presidents can face federal investigation, indictment, prosecution, conviction, and punishment for any criminal acts committed while in office.
Trump’s notice of appeal does not include legal arguments, which will be presented in a subsequent filing. However, Trump’s legal team criticized Chutkan’s decision, contending that the court erroneously denied Trump’s claim of Presidential immunity for federal criminal prosecution related to official acts. 📜🔍
